TERMS & CONDITIONS – KIM’S KETO 365 COACHING

By purchasing any program, service, or product from Kim Forbes Coaching (“the Coach”, “I”, “me”), you (“the Client”, “you”) accept and agree to these Terms and Conditions in full. Please read them carefully before proceeding.

1. Eligibility

  • You must be 18 years or older to purchase or participate in coaching programs.
  • By engaging in my services, you confirm that you are legally capable of entering into a binding agreement.

2. Nature of Services & Disclaimer

  • I am a certified nutrition coach. I am not a medical doctor and I do not diagnose, treat, or cure medical conditions.
  • Coaching, advice, and content provided are for educational and informational purposes only and should not replace medical advice.
  • Always consult your doctor or other qualified healthcare provider before starting any diet, exercise, supplement, or lifestyle program.
  • You agree to take full responsibility for your own health decisions and understand that participation is at your sole risk.

3. Liability & Indemnity

  • You understand and accept that I shall not be held liable for any direct, indirect, incidental, or consequential damages arising from your participation in coaching programs.
  • By purchasing my services, you agree to indemnify and hold harmless me, my affiliates, and employees against any claims, damages, losses, or expenses (including legal fees) arising from your use of my services.

4. Payment Terms

  • Coaching fees are payable in advance via Paystack (debit/credit card, recurring subscription) or via EFT into the business bank account provided.
  • For Paystack payments: clients are responsible for managing their own subscriptions, including cancellations. Payments already processed via Paystack are non-refundable.
  • For EFT payments: proof of payment must be sent before the start of the new coaching period to secure your spot. EFT payments are also non-refundable once processed.
  • If no payment has been received before the new month starts (without prior arrangement), you will automatically be removed from the coaching groups and forfeit your place.

5. Coaching Sessions (Private Coaching)

  • Private coaching includes up to 4 calls per month. If a month has 5 weeks, no call is held in the final week.
  • Calls must be booked in advance. No-shows will be forfeited.
  • I will wait up to 10 minutes for you to join a scheduled call. If you do not arrive, the call is considered forfeited.
  • Cancellations: Calls must be cancelled at least 24 hours in advance, otherwise the session is forfeited.
  • Weekly check-ins are available Monday–Friday only.
  • Coaching queries outside calls/check-ins must be sent via private message (for private coaching clients).

6. Group Coaching

  • Group coaching includes 4 group calls per month. If a month has 5 weeks, no call is held in the final week.
  • Group calls are conducted via Zoom; replays are uploaded to the Facebook group.
  • Questions may be posted in the group in advance of calls.
  • Group queries must remain in the group. Private messaging for group coaching is not available.
  • You may use the anonymous posting option in the Facebook group for sensitive questions.
  • Group chats (WhatsApp/Facebook) are subject to the POPIA Act. You may not share or use other members’ personal information outside the group.
  • Disrespectful behaviour, discrimination, or prejudice of any kind will not be tolerated. You will be removed immediately with no refund.

7. General Coaching Rules

  • Coaching requires active participation. Results cannot be guaranteed without your engagement.
  • Calls, check-ins, and direct access to me are available only during business hours:
    • Weekdays: 09:00 – 19:00
    • Saturdays: 09:00 – 13:00
    • Sundays & Public Holidays: Not available
  • Existing clients may secure the next month’s material by confirming continuation in advance. However, once materials are delivered, payment for that month becomes due.
  • Existing clients retain their current rate. If you leave coaching and later return, you will be charged at the current rate at the time of rejoining.

8. Intellectual Property

  • All materials, guides, programs, videos, and content provided remain the property of Kim’s Keto 365 Coaching.
  • You may not reproduce, share, distribute, or sell any content without my written permission.

9. Confidentiality & Privacy (POPIA Compliance)

  • I respect your privacy and handle personal data according to the Protection of Personal Information Act (POPIA).
  • By joining, you consent to the collection and use of your personal information solely for the purpose of providing coaching services and payment processing.
  • I use Paystack as my payment processor; Paystack’s privacy policy applies to all payment information.
  • You may request access, correction, or deletion of your personal data at any time.

10. Termination of Services

  • I reserve the right to terminate coaching services immediately if you violate these Terms and Conditions, including group rules, payment terms, or respectful conduct requirements.
  • No refunds will be given for termination under these circumstances.

11. Governing Law

  • These Terms and Conditions shall be governed by the laws of the Republic of South Africa.
  • Any disputes will be subject to the jurisdiction of South African courts.

12. Acceptance

By ticking the acceptance box on the Paystack payment page, you confirm that you have read, understood, and agree to these Terms and Conditions.
